11. Involuntary servitude is prohibited by the Thirteenth Amendment to the U.S. Constitution, except as a punishment for convicted prisoners. Forcing a prisoner to work may be considered punishment for purposes of the Fourteenth Amendment. Since pretrial detainees have not been convicted, they cannot be punished. The prohibition against punishment includes involuntary jail work assignments. However, the courts have recognized that prisoners can be required to perform housekeeping functions such as cleaning their living area. Since prisoners cannot expect free housekeeping services in the free world, they should not expect such services while incarcerated in jail.

11. Staff shall encourage all inmates to participate in good personal hygiene practices in addition to the required personal hygiene practices. Inmates may have long hair, beards, and mustaches. However, if a management problem is created as a result of this, PCF may consider such problems in decisions involving the inmate's housing assignment, access to programs, job opportunities, and other matters.
