AB 14_101  DEFINITIONS

  1. WCSO:  Washington County Sheriff's Office
  2. Peace Officer:  Includes “law enforcement officers,” “correctional officers,” and “special function officers” as defined by Utah statute.
  3. Reserve Officer:  A certified peace officer working for the WCSO in a part-time or auxiliary capacity.
  4. Reserve Civilian:  Someone working for the WCSO in a part-time or auxiliary capacity who is not a certified peace officer.

AB 14_103  GENERAL

  1. Policy:
    1. The WCSO may utilize staff in a reserve or auxiliary capacity.
    2. Reserve staff shall not be allowed to participate in the WCSO Ride-Along program as non-paid volunteers.
    3. The number of current reserve staff members shall be determined by the Sheriff.
    4. Reserve Civilians must be at least 18 years of age.
    5. Reserve Officer applicants must be certifiable by Utah Peace Officer Standards and Training as a Peace Officer at the time of application.
    6. Reserve staff shall be subject to the same background checks, screenings, and evaluations as regular full-time staff.
    7. A Reserve Civilian does not have peace officer authority and shall not engage in peace officer activities.
    8. A Reserve Officer has peace officer authority only while engaged in the reserve activities authorized by the WCSO and shall exercise only that spectrum of peace officer authority:
      1. That the WCSO is empowered to delegate; and
      2. For which the officer has been trained and certified.
    9. Reserve staff shall comply with all other WCSO policies and procedures.
    10. While serving as a non-paid volunteer in a reserve or auxiliary capacity, or working part-time for fewer hours than that which would qualify the officer as an "employee" under state or federal law, a peace officer is entitled to benefits in accordance with Utah Code, Title 67, Chapter 20: Volunteer Government Workers Act.
    11. The WCSO shall ensure that Reserve Officers meet the basic and in-service training requirements of the peace officer classification in which the officer will function.
  2. Rationale:
    1. The use of reserve staff may allow the WCSO to more effectively manage staff shortages and emergency situations.
    2. Reserve staff is governed by Utah statute.

AB 14_104  RESERVE GUIDELINES

  1. Policy:
    1. Reserve staff may work no more than 1456 hours during the standard measurement period beginning December 1st and ending November 30th.
    2. Reserve staff may work only at the request of the Washington County Sheriff's Office.
    3. Reserve staff are not obligated to work.
    4. Reserve shifts shall be no less than two hours in duration.
    5. Reserve staff may be dismissed at the will of the Sheriff's Office.
  2. Rationale:
    1. Certain components of the reserve program are established by state and federal law such as maximum hours that may be worked by a part time employee.

AB 14_105  UNIFORM ALLOWANCE

  1. Policy:
    1. Reserve staff may receive a uniform allowance according to the current uniform allowance procedures.
    2. Uniform allowances are not a right and may be changed or eliminated at any time.
  2. Rationale:
    1. Because the needs of the WCSO are ever-changing, the use of the WCSO's limited resources may need to be adjusted.

AB 14_106  TERMINATION

  1. Policy:
    1. Reserve staff may be terminated by the Sheriff (or designee) at any time, with or without reason.
    2. Reserve staff may resign from the program at any time. A written letter of resignation should be submitted to the program supervisor.
    3. Reserve staff who leave the program must surrender all WCSO property.
  2. Rationale:
    1. Not all of the employment rights and privileges for regular full-time staff are extended to reserve staff.
